The Internet payment site accessed through this website offers a payment service for your convenience and use. Please read this consumer terms and conditions carefully before accessing or using the service. By clicking “SUBMIT” or by using the service, you agree to be bound by these terms. A $5.00 (five dollar) convenience fee will be charged for the processing and handling of your payment. The convenience fee may be void in certain states. You have the option to send payment via check, money order or cashiers check if you do not wish to incur the $5.00 convenience fee charged by the credit card processor Pay N Seconds. Electronic Communication Disclosure

By providing an email address within your Contact Information, you consent to receive information about any account Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc holds in your name and any other related documentation that could be provided in writing (“Account Information”) to be delivered in electronic format. This consent applies specifically to your Account Information.

You are always entitled to receive a paper copy of your Account Information. You simply need to contact Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc through the “Consumer Services” option at our website at [email protected]. Upon receipt of your notice, Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc will mail a paper copy of any of the documents originally delivered in electronic format within 45 business days. You may also contact us at the above-listed contact points to revoke your overall consent to electronic communications. No fees shall be assessed against you if you choose to revoke your consent.

By providing your email address within your Contact Information, you further agree that you have access to the hardware and software requirements necessary to review, upload and/or print your Account Information. The software and hardware requirements include having a valid email address that is personal and private to you, along with the ability to open a PDF document through a free Adobe® or similar viewing program. New Contact Information

As long as your consent is valid, you understand you must notify Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc of any change in your Contact Information. You take sole responsibility for failure to provide Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc with updated Contact Information.

Credit card transaction

By submitting a credit card payment through this service, you agree to the terms and conditions of this agreement and you agreed to pay for this charge under the terms of the agreement you have with your credit card issuer. You further agree you are making this payment voluntarily and will not dispute the charge with your credit card company. This user agreement forms a legally binding contract between you and Credit Service of Logan, DBA CheXcel or Statewide Collections, llc, and this agreement constitutes a written agreement signed by you under any applicable law or regulation. It is also agreed that our acceptance of a payment for less than the full amount you owe will not constitute an agreement by us to accept monthly payments. If you pay less than the full amount you owe, we reserve the right to continue with any, and all, collection action necessary to collect the entire balance due.

Your payment transaction will be completed upon (a) approval by your credit card company and (b) Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc, acceptance of your payment. If your payment does or does not process for any reason, Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc, may contact you using the contact information you have provided to them or to your original creditor. By agreeing to the payment processing terms and conditions set forth on this page, you consent to Credit Service of Logan, DBA CheXcel or statewide collections calling you on your cell phone or sending you a text message on your cell phone. Furthermore, you agree that Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc,may contact you via email. You agree to hold harmless Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc if for any reason a third-party sees your phone messages or email messages with or without your permission. If your payment does not process for any reason, your account will not be credited with a payment. You will remain responsible for the outstanding balance on your account as well as any penalties, late fees and interest charges that may be legally applied to your account.

Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable to you or any third-party for any direct, indirect, special, incidental, consequential, special, punitive, exemplary, or multiple damages of any kind in connection with or arising out of your use of this site or the services. If we learn or you inform us that we have made a mistake in applying your payment, we will take one of the following actions, at our sole discretion: (i) if you have paid a fee to access the site, we will refund the fee to you; or (ii) we will reapply the payment in accordance with your original instructions. This is your sole and exclusive remedy.

Indemnification

You shall ensure us against any damages we may suffer from your failure to abide by these terms and conditions.

Arbitration

At the election of either you or us, any claim, dispute, or controversy (“Claim”) by either you or us against the other, or against the employees, or agents or assigns of the other, arising from or relating in any way to this agreement or your account(s) or any transaction on your account(s) being collected from you by Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc, shall be submitted to binding arbitration. You further agree that no class actions, joinder, or consolidation of any claim, with a claim of any other person or entity shall be allowed in arbitration, without the written consent about you and us.

Notices

You agreed that we may provide notices to you by using one or more of the following methods: posting them on this site; emailing them to an email address that you have provided to either Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc, or the original creditor; sending them via text message to a mobile number that you provide or we find belongs to you or have reason to believe belongs to you or you have access to; or by mailing them to a postal address that you have provided or we find or believe to be your residence. You agree all notices by any of these methods shall be deemed received by you no later than 24 hours after they are sent or posted, except for notices by mail, which shall be deemed received by you no later than five calendar days after it is mailed. State Specific Language

Utah Residents: As required by Utah law, you are hereby notified that a negative credit report reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations. We will not submit a negative credit report to a credit reporting agency about this credit obligation until the expiration of the validation period that was included in the initial communication you received.

California Residents: The state Rosenthal Fair Debt Collection Practices Act, and the federal fair debt collection practices act require that, except under unusual circumstances, collectors may not contact you before 8 AM or after 9 PM. They may not harass you by using threats of violence or arrest or by using obscene language. 1- Collectors may not use faults or misleading statements or call you at work if they know or have reason to know that you may not receive personal calls at work. Nevada Residents: If you agree to pay the debt or any portion of the debt, the payment or agreement to pay may be construed as: an acknowledgment of the debt by you; and a waiver by the consumer of any applicable statute of limitations set forth in NRS 11.190 that otherwise precludes the collection of the debt; and if you do not understand or have questions concerning your legal rights or obligations relating to the debt, you should seek legal advice.

Refunds

In the event where a refund is requested and warranted, a refund for the services charged must be reimbursed to the credit card account charged in the initial transaction.

What is Pay N Seconds?

Pay N Seconds is the third-party vendor contracted with Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc To provide secure online payments, and additionally has contracted to process online credit card payments for Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc customers.

Why are we using a third-party Vendor?

Pay N Seconds has the expertise in online payment systems to meet all security and privacy issues and meets the banking and credit card industry compliance requirements. Our contract with them ensures that the processes are compliant with all regulations governing the processing of online credit card payments.

Jurisdiction governing this agreement shall be in Utah.

By clicking “SUBMIT” you agree to terms and conditions set forth and said terms and conditions will apply to you, your spouse and any legal dependence. Furthermore, this agreement covers all past, current, and future accounts, debts or claims against Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc

This agreement is between you, and Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc whose corporate office is located at 180 N. Main, Logan, UT 84321.

Electronic signature agreement

By selecting “SUBMIT” you are signing this agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this agreement, by selecting “SUBMIT” you consent to be legally bound by this agreements’ terms and conditions. You further agree that your use of a keypad, mouse or other device to select an item, button, icon or similar act or action, or to otherwise provide Pay N Seconds or Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc or in accessing or making any transaction regarding any agreement, acknowledgment, consent terms, disclosures or conditions constitute your signature (hereafter referred to as “E-Signature”), acceptance and agreement as if actually signed by you in writing. You also agree that no certification authority or other third-party verification is necessary to validate your E-Signature and that the lack of such certification or third-party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and Credit Service of Logan, inc., DBA CheXcel or Statewide Collections, llc You also represent that you are authorized to enter into this agreement for all persons who owned or are authorized to access any of your accounts and that such persons will be bound by the terms of this agreement. You further agree that each use of your E-Signature constitutes your agreement to be bound by the terms and conditions of this agreement.

This online payment does not constitute a payment plan.

You agree that all terms an conditions will continue to be covered under this agreement with regard to activity covered under this agreement that happened prior to the termination date.

It is agreed that if any part of this agreement is deemed un-enforceable all remaining terms and conditions shall remain enforceable.
